[RIZER-STUDIO] is the trading name of Henry Clark, a sole trader based in the United Kingdom. In these terms, "we", "us" and "Rizer" refer to Henry Clark trading as [RIZER-STUDIO]. "You" and "client" refer to the person or business engaging us. You can contact us at info@rizerstudio.com.
We design and build websites for clients on a recurring subscription basis. The specific scope, features and price for your project are agreed with you directly before work begins, and form part of these terms for your engagement.
Where we build a site for you, the build itself is invoiced directly and payable on the terms set out on that invoice. The ongoing subscription that keeps your site hosted and looked after is separate, and is handled as below.
Once your site is live, subscription billing is handled automatically through our payment provider, Stripe. Your card is charged on a recurring basis for your plan, rather than being invoiced individually for each cycle. Card details are entered directly with Stripe and are never seen or stored by us. Your use of Stripe is also subject to their own terms and privacy policy.
If a payment fails, we'll automatically retry it a number of times over the following days (a grace period, during which your site and Studio access continue as normal). If every retry fails, your subscription is cancelled and your site is suspended — taken offline and no longer editable — until a successful payment reactivates it. Suspension never deletes anything; see section 6.
If a delivered build doesn't match the agreed specification, we'll revise it until it does, at no extra cost, before any payment is due for that cycle.
If you ask for something beyond what was originally agreed for that cycle, we'll let you know before doing the extra work, and we may adjust the price to reflect the new scope. We won't carry out work outside the agreed scope, or charge you for it, without your agreement first.
As this is a subscription, either party may cancel future billing cycles at any time by giving notice in writing (email is fine), or by cancelling through your billing settings where available. No further payment is taken once you cancel. Cancellation doesn't affect payment already due for a cycle you've already approved.
After cancellation (or after a failed payment's grace period runs out, per section 3), your site is taken offline and Studio editing is paused. This is a suspension, not a deletion — see section 6.
Ownership of the work built for you in a given cycle transfers to you once payment for that cycle has been made in full. Until then, it remains our property.
You own your site and domain regardless of whether you continue your subscription. If your subscription lapses or you cancel, your site becomes inactive rather than deleted, and all your data is retained. Your site files remain available on request — contact us and we'll arrange an export.
Any non-public information you share with us about your business in the course of the project will be kept confidential and used only to deliver the work agreed.
We'll deliver the work with reasonable skill and care. We aren't liable for indirect or consequential losses, and our total liability in connection with your project is limited to the amount you've paid us in the twelve months before the claim arose. Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence.
These terms are governed by the law of England and Wales, and any disputes will be handled by the courts of England and Wales.
We may update these terms from time to time. If we make a material change, we'll let existing clients know before it takes effect.
